When marine mammals feel threatened, they may cause people harm. Cases have been reported where humans have been bitten by seals, knocked over by dolphins, or been hurt or killed trying to swim with large whales.

Likewise, grabbing onto a dolphin or seal might harm the animal and result in an injury to you. Boats and aircraft can also disturb, distress or harm marine mammals.

To protect whales, dolphins, seals and you, there are some rules about what you can and can't do when swimming or surfing around marine mammals.

Rules at a glance

It's important not to get too close to marine mammals when on the water. To reduce the risk of disturbance to natural behaviours:

  • boats are not permitted to approach within 100 metres of a dolphin or 200 metres of a whale
  • jet skis are not permitted within 300 metres of either a whale or dolphin
  • caution zones apply within 300 metres of a whale, within 150 metres of a dolphin and within 50 metres of a seal, subject to a range of other operating conditions.
Swimming and surfing

It is illegal to touch or feed whales, dolphins or seals.

Do not swim or surf within 30 metres of a dolphin.

Do not swim or surf within 50 metres of a whale.

Boating

It's important not to get too close to marine mammals when on the water.

To reduce the risk of disturbance to natural behaviours:

  • boats are not permitted to approach within 100 metres of a dolphin or 200 metres of a whale
  • jet skis are not permitted within 300 metres of either a whale or dolphin
  • caution zones apply within 300 metres of a whale, within 150 metres of a dolphin and within 50 metres of a seal.
Flying

All aircraft (including helicopters and drones) must:

  • not approach within 500 vertical metres, within a 500 metre radius, of a whale, dolphin or seal
  • avoid approaching marine mammals from head on
  • avoid flying over, or passing the shadow of the aircraft over, marine mammals
  • not land on water to observe whales
  • move away if a marine mammal shows signs of disturbance.
Licensed tour operators

Licensed marine mammal tour operators may approach within 300 vertical metres, or within a 300 metre radius, of a whale, dolphin or seal, subject to a range of other operating conditions.

The prevailing public perception of dolphins leads to expectations of friendly interactions with attention-seeking wild animals. Dolphins in captivity might seem to form intimate relations with their trainers while performing fun and exciting stunts. Dolphins are even involved in therapeutic and educational programmes aimed at to helping people overcome their difficulties. Here is why you should not attempt to swim or dive with dolphins:

  • You run the risk of harassing the animals while trying to position the boat in such a way that would enable a person to dive close to the group. Dolphins can move through water much faster than any swimmer so chasing them around is not going to give you a chance for a closer look.
  • Should you succeed in approaching the animals, bear in mind this situation is not safe for you or the dolphins. These are wild, untrained animals with unpredictable behaviour and should be treated with care and respect. People need medical attention due to bites and body strikes inflicted during such interactions.
  • While people in the water may become objects of interest for nearby dolphins, their curiosity should not be misinterpreted as friendly behaviour. A swimmer immersed in their habitat is foremost a foreign and unfamiliar object that needs to be investigated. By trying to seek out their attention, you are disrupting their natural behaviour and forcing them to abandon their current activities such as resting, feeding and socialising. You may force resting animals to move and expend energy, often to unfavourable areas where they are exposed to even more stress. If the pursuit persists, small calves can be strained to keep up with the pod.
  • The repeated presence of people in the water can also have the effect of decreasing fear of human interaction making them more vulnerable to boat strikes, entanglement in
    fishing gear or even intentional harassment.
  • Both humans and dolphins are mammals. Although sea water acts as an effective disinfectant, interaction with wild dolphins may result in disease transfer. These may present serious health threats to dolphins and humans alike.
  • Finally, swimming with dolphins represents harassment – you do not want to get a fine.

Our response is always the same: We totally get that people love the idea of being in the water with these beautiful creatures. However the reality is that it can be a really intrusive and stressful experience for the whales or dolphins targeted so we strongly discourage it and instead, advise people to go whale watching with a responsible operator, as a wonderful alternative that can benefit people and whales and dolphins.

We are not alone. Most countries with whale watch regulations either prohibit or strongly advise against swim-with, due to concerns about the safety and welfare of both swimmers and whales and dolphins.

The evidence really stacks up:

Swim tour boats can disturb whales and dolphins:

  • Swim-tour operators need to drop clients in the water close to whales or dolphins, increasing the likelihood of their everyday life and routine being disturbed, or being struck by boats.
  • These interruptions can be particularly harmful to mothers with calves. Over time, they may even have effects on the health and reproductive success of the population.
  • When their lives are interrupted by snorkellers, whales or dolphins can spend less time socializing, resting or being active ; they might change direction or dive to avoid swim tour boats. They might even abandon their usual habitat in favour of quieter areas.

It is easy for us to be excited at the idea of being in the water with whales or dolphins, but we forget that we are entering their realm as uninvited guests and our presence may not always be welcome.

Imagine sitting in your dining room. It is Sunday lunchtime and the table is heaped with food. Your dad is serving roast potatoes whilst your sister is helping her two year-old son eat his lunch. Suddenly, a coach squeals to a halt outside your front door and thirty people rush into your house, excitedly chatting and taking photographs from all angles. Eating is forgotten as children wail with anxiety, unsure about what is going on. Hard to cope with once, but what if that becomes your daily reality?

Dangers to swimmers in the open ocean

It’s not just the whales and dolphins who are at risk:

■ Whales and dolphins are large (often extremely large) and typically, are robust and powerful. They may react unpredictably - this is especially true of females with young calves - and may injure people who get too close

■ This high-risk activity is not always covered by travel insurance

■ Many encounters take place in deep waters with strong currents or waves, which can be alarming if you are not a confident swimmer.

Our catamaran was headed back to the main island. No longer expecting adventure, passengers were now passively waiting, snacking on tropical fruits, casually scrolling through their photos of the day, and even falling asleep. The aquamarine ocean view no longer captivated them, like it had just hours earlier before we snorkeled. Drunk on ocean water, papaya, and equatorial sun, we were ready to head back to land. Then, the crew shouted something that woke us all back up.

“Dolphins ahead!” I sprinted to the bow of the boat to catch a glimpse. Their fins barely broke the surface, making the majestic creatures appear as tiny blips in the ocean. Our boat slowly closed in on the dolphins, but they didn’t swim away. Now we could see them circling below.

“Anyone want to swim?” a crew member asked.

He didn’t have to finish his sentence before I threw my binoculars into a chair and unwrapped my towel. I quickly secured my goggles and jumped in before the dolphins would swim away. I submerged underwater, but saw nothing. I came back up for air. The crew member asked if I could see anything, and I responded no.

I tried again. After a few seconds, I saw the dolphins. I was in water about 15 m deep, approximately the same depth of the dolphin tank at the Niagara Aquarium I would visit as a child. As a young girl, I would stand up against the glass and watch the dolphins circle around the tank right in front of me. Now I felt like I was in the dolphin tank. The dolphins circled around me the same way I had watched them circle in their tank many years ago. It was one of the most magical experiences of my life.

Why I Regret It

Over a decade later, I thought this was an ethical way to swim with wild dolphins. A way where the dolphins were not forced to be there by nets built into the beach and kiss tourists on the cheek, like they are in “swim with the dolphins” adventures in Florida, Hawaii, and other vacation destinations.

My dolphins could swim away if they wanted to and were by no means captive. But I realized I, a wildlife biologist with a Ph.D., could be wrong.

I posted about this experience on Facebook, only to have my marine biologist friend of mine point out that jumping in the water with marine mammals is never a good idea. It could stress them out, and if there are mother dolphins with calves, separate them.

A few months later, a summary of a recent study popped up on my weekly Science email newsletter. Swimming with wild spinner dolphins in the Middle East was possibly contributing to their declines. This species of dolphin hunts at night and therefore sleeps during the day. Tourists that try to swim with them are disrupting their sleep. Imagine if someone jumped in your bed in the middle of the night!

What should you not do while swimming with dolphins?

Researchers found that in an area with higher levels of tourism in Egypt, the dolphins are doing more aerial displays. This is a sign they are NOT happy, which ironically leads to better tourist experiences because people love watching dolphins leap into the air. A study in Hawaii showed these dolphins have been in decline since the 90s, but we don’t know if tourism is the cause. The good news is that once tourists found out that they were disturbing the dolphins, some expressed remorse. While regulations are needed, it’s important to spread these messages because if people don’t pay for it, it will stop. I would be happy to sacrifice the magical dolphin encounter I wrote about above to prevent damage to wildlife populations, especially for a species in decline.

Should You Never Swim with Wild Dolphins?

To complicate the story even more, there can be instances where it is okay to swim with some species of wild dolphins. I submitted this piece for my “Science Writing for the Public” class, and she happened to review it. She told me that some species are very curious and will even come up to tourists in the water.

What’s a girl to do? How do you then know when it’s okay and not okay to swim with wild dolphins? Here’s my advice: If you are going to an attraction that specifically advertises swimming with wild dolphins, be wary and do your research. What species will you have encounters with? Google those species and see if there are negative impacts that ecotourism has on them, as in the case with the spinner dolphin. If you are not sure, contact or tweet me and I will find out from a marine biologist.

If you are on an adventure not specific to dolphins, such as snorkeling or scuba diving, I would adhere to my marine biologist friend’s recommendation and not jump in the water if you see dolphins. As she mentioned, this could stress them out, separate mothers from calves, and disrupt natural behaviors. This advice aligns well with the rules of the Marine Mammal Protection Act set by the United, which prohibits the “taking” of marine mammals. Take is defined not only as hunting and killing, but the harassment of marine mammals. Harassment includes pursuing, tormenting, and/or chasing and is basically any act that can disrupt the animals’ natural behaviors. I would add jumping into the water to this list.

The only way to swim with wild dolphins ethically, is to let them be in charge. If you are in the water for a snorkeling or scuba diving adventure and a dolphin comes to you, consider yourself lucky and enjoy this magical experience!
